Welcome to SecretStream! These Terms of Service ("Terms") govern your access to and use of the SecretStream ("SecretStream," "we," "us," or "our") website, applications, and AI-powered face-swapping services (collectively, the "Service"), operated by Veteq Labs, LLC, a Delaware Limited Liability Company.

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are under 18 years of age, or if you do not agree to these Terms, you must not access or use the Service.

1. Service Scope & Description

SecretStream provides an AI-powered service that allows users to:

1. Upload their own "User-Uploaded Target Images." These images may contain your own human likeness or the likeness of other identifiable individuals.
2. Select "AI-Generated Faces" from a gallery provided by SecretStream. These faces are created by our AI.
3. Combine the User-Uploaded Target Image with an AI-Generated Face to create a "Processed Image," thereby replacing an existing face in the User-Uploaded Target Image with an AI-Generated Face.

You bear sole and complete responsibility for the User-Uploaded Target Images you provide, for obtaining all necessary consents for such images, and for any Processed Images you create, share, or publish using the Service. SecretStream is a tool, and you are responsible for using it ethically and legally.

2. Eligibility & Account Registration

• You must be at least 18 years old to create an account and use the Service.
• You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• You are responsible for safeguarding your account password and for any activities or actions under your account, whether or not you have authorized such activities or actions. You must notify us immediately of any unauthorized use of your account.
• You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

3. User Obligations & Acceptable Use

• Age Confirmation: By using the Service, you confirm that you are 18 years of age or older.
• Lawful Use: You agree to use the Service only for lawful purposes and in accordance with these Terms and all applicable local, state, national, and international laws and regulations.
• Consent and Rights for User-Uploaded Target Images (Critical Warranty):
  • You represent and warrant that for any User-Uploaded Target Image you submit to the Service that contains an identifiable human likeness:
    • (i) The likeness is your own; OR
    • (ii) You have obtained explicit, verifiable, and legally sufficient consent from each and every identifiable individual depicted in the User-Uploaded Target Image to submit their likeness to the Service for the purpose of creating a Processed Image (face-swapping), and for the processing of their biometric data as described in our Privacy Policy. This consent must be freely given, specific, informed, and unambiguous, and permit the use of their image in the manner contemplated by the Service.
  • You agree to provide SecretStream with proof of such consent(s) promptly upon our request.
  • You understand that uploading images of individuals without their explicit and informed consent may violate their privacy rights, publicity rights, data protection laws, and other applicable laws, and you are solely responsible for any such violations. SecretStream does not and cannot verify such consents on your behalf.
